Copyright Dispute Policy (DMCA)

At BlingMyst, we take copyright protection seriously and comply fully with the Digital Millennium Copyright Act (DMCA) and all applicable intellectual property laws. We are committed to addressing copyright infringement claims promptly and responsibly. In accordance with the DMCA, we reserve the right to:

  • Remove or restrict access to content we believe, in good faith, infringes on the copyrights of others.

  • Terminate services for users found to be repeat infringers.

Use of BlingMyst’s website and services is subject to our Terms of Service, which includes and incorporates this Copyright Dispute Policy. Any terms not defined herein are as described in our Terms of Service.

How to Submit a Copyright Infringement Notice

If you believe your copyrighted material is being used on our site without authorization, please send a formal DMCA notice to our Designated Agent. Your notice must include the following details:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

  2. Clear identification of the copyrighted work(s) being infringed.

  3. Specific identification and location (URL or description) of the infringing material so we can locate it.

  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

  5. Your full contact information, including name, address, phone number, and email address (if available).

  6. A statement made under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

What Happens Next

Upon receiving a valid notice, BlingMyst may take the following actions:

  • Remove or disable access to the allegedly infringing content.

  • Notify the content provider who posted the material of the removal.

  • Terminate repeat offender accounts, if applicable.

Submitting a Counter-Notice

If you are the content provider and believe that your content was removed in error or is not infringing, you may file a counter-notice. This notice must include:

  1. A physical or electronic signature of the content provider.

  2. Identification of the material removed or disabled, along with its prior location.

  3. A statement, under penalty of perjury, that the removal was a mistake or misidentification.

  4. Your name, address, telephone number, and email address (if available).

  5. A statement that you consent to the jurisdiction of the Federal District Court in the district of your address (or where BlingMyst is located if you reside outside the U.S.), and that you will accept service of process from the original complainant.

If a valid counter-notice is received, we may restore the removed material within 10 -14 business days, unless the original complainant files a legal action to prevent its reinstatement.
